Illinois Modifies C&D Laws

The Illinois Legislature has passed legislation that modifies the state’s current laws on C&D recycling to improve the atmosphere for recyclers. In addition, the law improves the markets for shingle recycling. The legislation was moved forward thanks to work from the CMRA Illinois Chapter.

HB 1326 amended the Illinois Environmental Protection Act. It authorizes the owners and operators of facilities accepting exclusively general construction and demolition debris to receive double the credit for asphalt shingles they divert to a shingle recycling facility approved by the department. It also amends the Illinois Highway Code to require the Illinois Department of Transportation’s asphalt mix designs to allow for the use of recycled shingles in specified quantities. The DOT has to set the goal of maximizing the use of recycled materials in asphalt paving projects and to report annually on projects initiated or abandoned to meet these goals. HB 1326 also authorizes legislative committee hearings to be held to review the findings in the annual reports.
